AMARAVATI, India, Feb. 17 -- Andhra Pradesh High Court issued the following order on Jan. 16:

1. The Criminal Petition has been filed under Sections 480 and483of theBharatiya Nagarik Suraksha Sanhita, 2023 (for brevity 'the BNSS'), seekingtoenlarge the Petitioner/Accused on bail in Crime No.102 of 2025of Cheepurupalli Police Station, Vizianagaram, registered against thePetitioner/Accused herein for the offences punishable under Sections329(3), 118(1), 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for brevity 'theBNS').

2. Heard the learned counsel for the petitioner and the learnedAssistant Public Prosecutor. Perused the record.

3. This is a second bail application, the first bail application was dismissedvide order dated 24.12.2025 in Criminal Petition No.12931 of 2025ontheground that investigation was pending and the wound certificate wasnot yet received.

4. Learned Assistant Public Prosecutor submits that wound certificatehasbeen received and investigation is at nascent stage and it is revealedthat thevictim suffered only simple injury. The Petitioner was arrested on 24.11.2025. The Petitioner has been in the judicial custody for the past 54 days. Thealleged offence was taken place on 20.11.2025, whereas the victimhaschosen to lodge report on 23.11.2025, nearly there is a delay of 3 daysinfilingthe report with the police.

5. Considering the facts and circumstances of the case, the natureandgravity of allegations levelled against the Petitioner/Accused, this Court isinclined to enlarge the Petitioner/Accused on bail.

6. In the result, the Criminal Petition is allowed with the followingstringent conditions:

i. The Petitioner/Accused shall be enlarged on bail subject tohe executing bond for a sum of Rs.25,000/- (Rupees TwentyFive thousand only), with two sureties for the like sumeachtothe satisfaction of the learned Judicial First Class Magistrate, Cheepurupalli.

ii. The Petitioner/Accused shall appear before the StationHouse Officer concerned, on every Saturday in between 10:00am and 05:00 pm, till cognizance is taken by the learned the Trial Court.

iii. The Petitioner/Accused shall not leave the limits of the Stateof Andhra Pradesh without prior permission fromthe StationHouse Officer concerned.

iv. The Petitioner/Accused shall not commit or indulgeincommission of any offence in future.

v. The Petitioner/Accused shall cooperate with theinvestigating officer in further investigation of the case and shall make himself available for interrogation by the investigatingofficer as and when required.

vi. The Petitioner/Accused shall not, directly or indirectly, make any inducement, threat or promise to any personacquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer.

vii. The Petitioner/Accused shall surrender his passport, if any, to the investigating officer. If he claims that he does not haveapassport, he shall submit an affidavit to that effect to theInvestigating Officer.
