India, April 7 -- Central Information Commission issued text of the following decision on March 7:
Information sought: The Appellant filed an RTI application dated 13.10.2023 (online) seeking the following information:
1. Supply the Certified copies of note sheets on which my application dt.02.08.2021 in regard to settlement of my leave account was submitted to the Managing Director, DKVIB.
2. Supply the Certified copy of Managing Director, DKVIB, email details received on 30.09.2021and 26.10.2021 from the applicant.
3. Supply the Certified copy of note sheets along with file No. on which my e-mail received on 30.09.2021 and 26.10.2021 was submitted to the Managing Director, DKVIB.
4. Supply the Certified copy of Managing Director, DKVIB, email details received on 11.09.2023 from the applicant.
5. Supply the Certified copy of note sheets along with file No. on which my e-mail received on 11.09.2023 was submitted to the Managing Director, DKVIB.
6. Supply the Certified copies of PIO, DKVIB, email details received from 09.09.21 to 11.09.2023.
7. Supply the Certified copies of note sheets with file No. on which my email received from 09.09.21 to 11.09.2023 was submitted to the Managing Director, DKVIB.
8. Certified copy of the approval of Managing Director as written in memo No. F.2(17)/DKVIB/ Admn./90-91/Vol.ll/ 11924 dt. 07/12/2015.
9. Full form of C.C.as shown at 95/N under M.D., DKVIB marked by Sh. Amit Yadav, C.I.on 08.07.2014.
10.Mention the Rules of RTI Act, 2005 under which the P.I.O. uploaded the replies of my sought information on the RTI site on 29.03.2022 and before.
11.Name of the competent authority to whom the power of issuing orders regarding attending office during COVID-19 was given by the DDMA.
12.Certified copy of order, circular etc., by which the Commissioner of Industries was appointed
13.Details of names of other staff to whom telephonic messages were sent to attend the office on alternative basis as mentioned in the office order No. F.3(1)/DKVIB/Admn./2020-21/ 51 Dated 05.05.2020.
14.Details of names of other staff to whom orders were issued to attend the office on alternative days. 15.Details of names of other staff as mentioned in the letter No.F.3(1)/DKVIB/Admn./ 2020-2021/51 Dated 05.05.2020.
Having not received any response from the PIO, the appellant filed a First Appeal dated 24.11.2023. The FAA vide order is not on record.
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Present in person.
Respondent: Shri Pawan Kishore Bhaskar, LO/PIO present in person.
The appellant stated that he has received a point-wise reply from the respondent on 11.11.2023, however he was not satisfied with the same.
The respondent stated that a point-wise reply has already been provided to the appellant vide letter dated 07.11.2023 a copy of which was handed over to the bench for perusal during hearing. He stated that appellant is a former employee of his organization and a habitual RTI applicant who filed multiple RTI applications seeking similar information just to harass the public authority, however, each of his RTI application has been duly replied on every occasion. He added that if the appellant is still not satisfied then he may visit their office to inspect the relevant records, the appellant agreed to avail the opportunity of inspection of records on a mutually decided date and time.
