India, April 7 -- Central Information Commission issued text of the following decision on March 7:

Information sought:

The Appellant filed an RTI application dated 31.07.2023 (online) seeking the following information:

"I booked a Maruti Grand Vitara, Delta CNG car from Shreyash Automotives, Mayapuri, New Delhi (copy of Booking receipt attached), which is under the jurisdiction of RTO, South West District 1, Sec.10 Dwarka (District Code 9).

Please provide me the number of: 1.Grand Vitara, Delta CNG and 2.Grand Vitara, Alpha CNG, cars that got registered in RTO office Dwarka (District Code 9) from Shreyash Automotives Pvt. Ltd., Mayapuri, New Delhi from 29.01.2023 to 11.04.2023.

The PIO's reply is not on record. Being dissatisfied, the appellant filed a First Appeal dated 04.09.2023. The FAA vide its order dated 14.09.2023, held as under.

"PIO/DTO (Dwarka) is directed to furnished the pointwise reply as per the RTI Act, 2005 within 15 days from today."

Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Present in person.

Respondent: Not present.

The appellant contended that number of vehicles of particular code has not been provided to him by the respondent till date despite clear cut directions from the FAA.

Respondent remained absent during the hearing.

Decision: The Commission after adverting to the facts and circumstances of the case and perusal of records observes that the FAA vide its order dated 14.09.2023 had directed the PIO that "PIO/DTO (Dwarka) is directed to furnished the pointwise reply as per the RTI Act, 2005 within 15 days from today..." But there is nothing on record to show that the PIO has complied with the directions of the FAA.

In view of the above, the Respondent is directed to comply with the directions of the FAA order dated 14.09.2023 and give updated and revised reply/information to the Appellant as per the documents available on record, strictly in consonance with the provisions of the RTI Act. The directions of the Commission should be complied within 4 weeks from the date of receipt of this order, failing which the present PIO stand show caused.

Notwithstanding the above, the Commission admonishes the conduct of the Respondent for remaining absent during the hearing despite prior intimation and cautioned him/her to be careful in future, failing which action may be initiated against him/her as per the law. A copy of this order be placed by the FAA before the controlling officer of the PIO.

FAA to ensure compliance of the directions.

The appeal is disposed of accordingly.
