GUWAHATI, India, Sept. 17 -- Gauhati High Court issued the following order on Aog. 19:
Heard Mr. S. Chauhan, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the respondent State.
It is submitted by Mr. P. Borthakur, learned Addl. P.P., Assam that the case diary is not received and intimation is received from the I.O.
On perusal of the record, it reveals that the present petition is pending since 18.09.2024 and even after the lapse of several dates, the I.O. failed to produce the case diary and considering this aspect of the case, the petitioner was granted with the privilege of interim pre-arrest bail on 23.01.2025. But in spite of the lapse of several dates, the I.O. could not furnish the up dated case diary till date.
In view of this, one more chance is granted to the I.O. to produce the up dated case diary on the next date fixed.
In the meantime, the learned Additional Public Prosecutor will obtain instruction as to whether the charge sheet is filed in this case.
List the matter on 01.09.2025.
Till then, the interim order passed earlier shall continue.
