GUWAHATI, India, Sept. 16 -- Gauhati High Court issued the following order on Aug. 18:

1. Heard Mr. S.M. Abdullah P, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State.

2. By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Shafikul Hoque, has prayed for granting pre-arrest bail, apprehending arrest in connection with Basistha P.S. Case No. 235/2025, registered under Section 305(e) of BNS, 2023 r/w Section 7 of Essential Commodities Act.

3. Mr. Haldar, learned counsel for the petitioner submits that the petitioner has appeared before the Investigating Police Officer as per direction of this Court and his statement has already been recorded after he was granted interim protection.

4. Mr. Goswami, learned Additional Public Prosecutor for the State submits that the case is stated to have been charge sheeted. The allegations are about transport of urea bags in violation of law. It appears that statement of petitioner has already been recorded by the investigating officer.

5. I have considered the submission made by the learned counsel for the parties and also perused the case diary.

6. In view of the completion of investigation, I deed it fit to allow this petition. Accordingly, the interim protection granted to the petitioner vide order dated 09.05.2025, is made absolute on the condition that he shall co-operate with the remaining investigation and not hamper or tamper with evidence.

7. The petition stands disposed of accordingly.
