GUWAHATI, India, Oct. 2 -- Gauhati High Court issued the following order on Sept. 1:
1. Heard Mr. A.W. Aman, learned counsel for the petitioner as well as Ms. A. Verma, learned standing counsel for the Foreigners Tribunal, Mr. A.I. Ali, learned standing counsel for the Election Commission of India and Ms. A. Gayan, learned CGC.
2. By filing this writ petition under Article 226 of the Constitution of India, the petitioner has assailed the impugned opinion dated 30.07.2024, passed by the learned Member, Foreigners' Tribunal 11th, Barpeta, in (Bpt/11th) F.T. case no.952/2016, arising out of IM(D)T Case No.1199/02, by which the petitioner was declared as an illegal migrant.
3. Issue notice returnable on 15.10.2025.
4. Since the respondents are represented, formal notices are dispensed with.
5. Requisite extra copies of the writ petition be furnished to the learned counsel for the respondents within 3(three) working days.
6. Let the relevant records be called for from the concerned Foreigners Tribunal by usual process as well as by email at the following email addresses: ft11barpeta@gmail.com
7. The prayer for bail shall be considered on receipt of the records from the learned Tribunal.
8. In the meanwhile, if the petitioner, namely, Sona Bhanu @ Shona Bhanu is apprehended, she shall not be deported out of the country without order of the Court.
9. The petitioner shall appear before the Superintendent of Police (Border), Barpeta, Assam with a certified copy of this order to bring it to his notice.
10. List the matter on 15.10.2025 along with the records.
