GUWAHATI, India, Aug. 8 -- Gauhati High Court issued the following order on July 10:

1. Heard Mr. D. A. Kaiyum, learned counsel for the petitioner. Also heard Mr. S. S. Roy, learned Govt. Advocate, Assam, appearing on behalf of the respondents.

2. The learned counsel for the petitioner is aggrieved by the order dated 5th of April, 2025, whereby the Co-District Commissioner, Golakganj, issued an order directing the petitioner to shift dry fish storage to another location from the residential area with the immediate effect. He has submitted that the petitioner has already been issued trade license for operating the dry fish in the said area and the same was renewed again on 04.06.2024 which is renewed upto 27.03.2025. Thereafter and subsequently, the same has been renewed upto 31.03.2026.

3. The learned counsel for the petitioner submits that this order was passed without giving an opportunity of hearing. No public complaints on the basis of which this impugned order was passed, was served on the petitioner, nor was he given an opportunity to represent against this purported complaints stated to have been made. He has also filed a representation dated 20.05.2025 and 02.06.2025. However, no response was forthcoming from the respondents.

4. Under such circumstances, this Court is of the view that the learned Govt. Advocate be permitted to obtain instructions.

5. List this matter again on 21st of July, 2025 and on the next date fixed, the impugned order dated 05.04.2025, shall not be given effect to and in order to enable the Govt. Advocate to obtain the required instructions, extra copies to be furnish within the course of the day.
