GUWAHATI, India, Nov. 4 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard Mr. M.Z. Shah, learned counsel for the petitioners. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor for the State.
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioners, namely, 1. Mithu Biswas and 2. Jamat Ali, has prayed for grant of bail in connection with Bilasipara P.S Case No. 226/2025 (GR No.386/2025) registered under Sections 303(2)/317(2) of BNS, R/W Section 13(i) of Assam Cattle Preservation Act.
3. It is submitted by the learned counsel for the petitioners that the accused persons are in custody since 06.08.2025.
4. Mr. K.K. Parasar, learned Additional Public Prosecutor for the State, upon instructions, submits that in the meantime, chargesheet has been submitted vide Charge-Sheet No.258/2025 dated 29.09.2025.
5. Considering the nature of the alleged offences; length of pre-trial detention and the completion of investigation - I deem it fit to grant bail to the accused persons at this stage.
6. Accordingly, the above-named accused petitioners are allowed to go on bail of Rs.25,000/- (Rupees Twenty Five Thousand) only each with one surety each of the like amount subject to the satisfaction of the concerned learned court with following conditions:
(i) That the accused petitioners shall be available for the trial, if one commences;
(ii) That the accused petitioners shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer;
(iii) That the accused petitioners shall not commit any offence while on bail.
(iv) That the accused petitioners shall not hamper or tamper any evidence.
7. Violation of bail conditions might entail cancellation of the bail.
8. With the above observations, this bail petition stands allowed and stands disposed of.
