GUWAHATI, India, March 10 -- Gauhati High Court issued the following order on Feb. 9:
1. Heard Mr. R.A. Choudhury, learned counsel appearing on behalf of the accused-applicants. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor appearing for the State respondent.
2. This is an application filed under Section 482 of the BNSS, 2023, praying for grant of pre-arrest bail to the accused-applicants, namely, Rahul Amin Laskar and Saju Mia @ Suju Mia in connection with Hailakandi P.S. Case No. 176/2025, registered under Sections 303(2)/317(2)/3(5) of the BNS, 2023, read with Section 13(1) of the Assam Cattle Preservation Act, 2021 corresponding to GR Case No. 548/2025.

The allegation, as narrated in the FIR dated 08.12.2025 by one ASI, namely, Dlwar Hussain Laskar of Hailakandi Police Station, that on the basis of secret information from reliable source that some culprits have stolen some cattle at Bhatirkupa Part-II for the purpose of slaughtering. The police team reached the spot, after seeing that, the three of the accused persons fled away, however one person was apprehended. The apprehended person disclosed the names of the other three accused persons including the accused-applicants in the instant case. The police have recovered 8 cattle and other materials from the sport. On receipt of the FIR, the police registered a case being Hailakandi P.S. case No. 176/2025 corresponding to G.R. Case No. 548/2025 registered under the aforementioned Sections.

The learned counsel appearing for the accused - applicants submits that the custodial interrogation of the accused - applicants are not required at this stage as the cattle have already been recovered and in fact the accused - applicants are not connected with the offence as alleged in the FIR in the instant case.
5. The learned Additional Public Prosecutor however opposes granting of bail to the accused applicants. 6. This Court, after hearing the learned counsel for the accused - applicants and also perusing the materials available on records, is of the considered opinion that at this stage the accused - applicants should be granted anticipatory bail as prayed for.
