GUWAHATI, India, Nov. 4 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard Mr. A. Paramanik, learned counsel for the petitioner assisted by Ms. P. Kalita, learned counsel. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State respondent.
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Raju Mandal, has prayed for regular bail in connection with Sipajhar P.S. Case No.114/2025 registered under Sections 281/125(b)/106(1)/105 of BNS.
3. The accused is stated to be in pre-trial detention since 31.07.2025.
4. The gist of the allegations in the FIR dated 31.07.2025 is that negligent driving of the dumper vehicle by the petitioner resulting in death of a woman and a child.
5. The learned Additional Public Prosecutor has submitted that in the meantime, investigation is completed resulting in a Charge Sheet vide C.S. No. 115/2025 dated 24.09.2025. The learned prosecution submits that since the Charge Sheet have been submitted, perhaps the petitioner can be directed to approach the learned Trial Court.
6. In view of the completion of investigation and the length of pre-trial detention, I deem it fit to allow the accused to go on bail at this stage. It is directed the accused/petitioner herein is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of like amount to the satisfaction of the learned Court of Chief Judicial Magistrate, Darrang, Mangaldai and subject to the following conditions that:-
i. the accused shall be available for trial upon commence.
ii. the accused shall not hamper or tamper with evidence.
iii. the accused shall not intimidate or harass or threaten the informant.
7. Violation of bail conditions shall entail cancellation of the bail.
8. Accordingly, this bail application stands allowed and disposed of.
