GUWAHATI, India, Nov. 4 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard learned counsel Mr. R. Ali for the petitioner Shariful Khan @ Sariful Khan, who has filed this application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since 12.08.2025 in connection with Barpeta Police Station Case No. 297/2025 under Sections 21(b)/29 of Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Heard Mr. D.P. Goswami, learned Additional Public Prosecutor, Assam. It is submitted by the learned Additional Public Prosecutor that there are incriminating materials in the Case Diary against the petitioner.
3. I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary. I have also considered the length of detention and the substantial progress of investigation.
4. It is true that there are incriminating materials in the Case Diary against the petitioner. I have considered the submission that the petitioner is willing to cooperate with the remaining part of investigation. The petitioner being a local resident is not a flight risk.
5. Considering all aspects, the petitioner is enlarged on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with one local surety of like amount to the satisfaction of the learned Special Judge (NDPS), Barpeta under the conditions that :-
(i) the petitioner shall refrain from such activities with which he is alleged and
(ii) the petitioner shall not leave the jurisdiction of the Court without prior permission.
6. On breach of any of the bail conditions, the Court is at liberty to immediately cancel the bail granted to the petitioner.
7. In terms of the above observation, this Bail Application stands disposed of.
8. Send back the Case Diary.
