1. Learned counsel for the parties are present.

2. Learned counsel for the appellants seeks adjournment on the ground that the arguing counsel Mr. Sumeet Kumar Gadodia is on legs in another court and he prays for not today.

3. This first appeal is of the year 2009 and the suit is of the year 1977. The suit was filed seeking specific performance of agreement dated 10.05.1970. The records of the case reveal that vide order dated 18.07.2023 the matter was adjourned by way of last indulgence and it was also stipulated that if the appellants fail to argue the matter, the application will stand rejected without further reference to the bench.

4. Since the arguing learned counsel is on the legs, at the request of learned counsel for the appellants, post this case for Final Disposal on Monday i.e. on 15th June, 2026 to be taken up at 02:15 PM.
