1. This matter is taken up through virtual mode.
2. This is an Interlocutory Application filed by petitioner for his release on interim bail for a period of eight weeks in connection with S.T. Case No.276/193 of 2022, arising out of Khandapada P.S. Case No.153 of 2022, pending in the Court of the learned Additional Sessions Judge-cum-Special Judge, Nayagarh for proper treatment and for surgical operation as he suffered from Cardio and Kidney related problems.

It is submitted by the learned counsel for the petitioner that though on earlier occasions the prayer for bail of the petitioner has been rejected by this Court, due to medical exigencies as the petitioner is suffering from Cardio and Kidney related problems, he requires immediate medical attention. Enclosing copies of Admission Card along with other medical documents issued by the S.C.B. Medical College and Hospital, Cuttack, she submitted that the petitioner requires immediate medical check-up and consultation with physicians. Hence she fervently prays for release of the petitioner on interim bail for a period of eight weeks.

Learned Additional Standing Counsel appearing for the State submitted that after receipt of copy of this interim application, he made an inquiry from the concerned Jail authority with regard to the health condition of the petitioner and the Jail authority intimated that the petitioner is, in fact, suffering from Kidney related problems, which requires immediate medical attention and proper consultation.
5. Considering the aforesaid submission of the learned counsel appearing for the parties, this Court is inclined to release the petitioner on interim bail. Hence, let the petitioner be released on interim bail for a period of fifty-five days from the date of his release by the Court in seisin over the matter in S.T. Case No.276/193 of 2022, arising out of Khandapada P.S. Case No.153 of 2022 on such terms and conditions as the said Court may think just and proper to ensure his return with the condition that he shall surrender to custody on fifty-sixth day of his release from custody.
6. With the aforesaid order, this Interim Application stands disposed of. Issue urgent certified copy as per rules.

7. List this BLAPL after eight weeks before the assigned Bench. Surrender certificate shall be furnished by the learned counsel for the petitioner in the meantime.
