CORAM:

THE HON'BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA

ORDER

12.06.2026

Order No. 03.

I.A No.399 of 2026

1. This matter is taken up through Virtual Mode.

2. This I.A. has been filed by learned counsel for the Petitioner seeking modification of order dated 21.05.2026.

3. Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the I.A.

4. Learned counsel for the Petitioner, at the outset, contended that by virtue of order dated 21.05.2026, this Court was pleased to release the Petitioner on bail subject to the terms and conditions mentioned in the said order. He further contended that the Petitioner has clearly mentioned in his bail application as well as in the I.A. the details of his antecedent. After taking into consideration the antecedent, this Court had passed the order dated 21.05.2026. However, inadvertently, conditions have been imposed with regard to the verification of the antecedent of the Petitioner and, in the event the Petitioner was found to be having more than one criminal antecedent, the order was directed not to be given effect to.

5. On a careful consideration of the submissions made by learned counsel for the Petitioner, further keeping in view the record, it appears that verification of antecedent as directed by this Court is an inadvertent error as has been indicated in sub-para of para-5 of the said order. Accordingly, the said portion of the order is modified to the extent that the learned court in seisin over the matter shall verify the antecedent of the Petitioner and that in the event it is found that the Petitioner is having any antecedent other than the one which has been disclosed by the Petitioner in the I.A. as well as the bail application, this order shall not be given effect to.

6. Accordingly, the I.A. stands disposed of.
