NAINITAL, India, July 8 -- Uttarakhand High Court issued the following order on June 17:

1. Mr. D.K. Sharma, learned Senior Counsel assisted by Mr. Digvijay Singh Bisht and Mr. Jaideep Sharma, learned counsel for the applicant.
2. Mr. Pratiroop Pandey, learned AGA, for the State of Uttarakhand.
3. The present applicant - Hina Rawat @ Ankita Sharma @ Nikita Singh D/o Sri Balwant Singh, is praying for bail in reference to FIR dated 06.06.2025 bearing FIR No. 0265 of 2025, at Police Station Rudrapur, District Udham Singh Nagar, wherein, she has been implicated for the offences punishable under Sections 308(4), 308(6) and 318(4) of BNS, 2023. On completion of the investigation, now the applicant is facing trial for the offences punishable under Sections 308(4), 308(6), 318(4), 336(3), 340(2) and 337 of BNS, 2023.

It is argued by the learned Senior Counsel for the applicant that the applicant is languishing in jail since 06.06.2025, and the applicant has been left by her husband and is looking after her ten-year-old son, who is living with the applicant's aged mother suffering from various medical ailments. It is submitted that there is no one else to look after the minor son and the aged mother. A specific averment has been made in this regard in paragraph 16 of the bail application.
5. A detailed counter affidavit has been filed wherein there is no denial of the averments made in paragraph 16, as the same are based upon the personal knowledge of the deponent.
6. Taking into consideration that the applicant has a ten-year-old minor son, who is living with the applicant's aged mother, this Court is of the view that instead of granting regular bail at this stage, the applicant be admitted to interim bail for a period of four weeks.
7. Learned AGA has not raised any objection, submitting that the applicant, being the mother, has a responsibility to look after her minor son.
8. In such view of the matter, the instant bail application is kept pending and be posted after three weeks.
9. In the meantime, let the applicant be admitted to interim bail for a period of four weeks to be reckoned from the date of her release. Let the applicant, Hina Rawat @ Ankita Sharma @ Nikita Singh, be released on bail on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned. It is made clear that the applicant shall surrender before the Court concerned on or before the expiry of the interim bail period.
