RANCHI, India, Sept. 9 -- Jharkhand High Court issued the following order on July 8:

1. Heard learned counsel for the parties.

2. The present writ petition has been filed for the following relief :-

(a) for issuance of a writ in the nature of Mandamus or any other appropriate Writ(s)/ Order(s) commanding upon the respondents to consider the objection raised by the Petitioner against the amount of compensation for acquisition of land with residential house for the purpose of widening of NH2 in respect of Award No:92 and 94 in connection with L.A. Case No:24/2014-15 and to pass an appropriate order under the provisions of the National Highway Act, 1956 and within a specified period;.

3. A counter affidavit has been filed by the respondentsState. Paragraph - 7 of the counter affidavit is relevant which is quoted herein-below :-

"7. That it is humbly stated and submitted that in the light of objection made by the parties, District Land Acquisition Officer, Giridih referred the matter to Principal District Judge -cum- Authority Land Acquisition Officer Rehabilitation and Resettlement Officer, Hazaribagh under section 64 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 vide letter no.2199 dated 20.12.2019 for its adjudication. Thus instead of proceeding with the present writ application. The writ petitioner should co-operate and assist to the Principal District Judge -cum- Authority Land Acquisition, Rehabilitation and Resettlement Officer, Hazaribagh for its expeditious adjudication."

4. In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to pursue his remedy before the appropriate authority where the matter has been referred.

5. Learned counsel for the State has no objection.

6. Accordingly, the present writ petition stands disposed of with the aforesaid liberty.

7. Pending interlocutory application, if any, stands disposed of.
