RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:
1. Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection with Pachamba P.S. case no.75 of 2025, for offence registered under section 126(2), 115(2), 117(2), 118(2), 109(1), 304(2), 3(5), 351(2) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Giridih.
3. Learned counsel for petitioner submits that there are case and counter case between the parties and the altercation took place due to not fixing of the marriage with the son of Tabarak Ansari and the injury is there however there are general and omnibus allegations against all the accused persons and the accused person as well as the informant side are family members.
4. Learned State counsel opposes prayer and submits that injury has been received by the informant.
5. Considering that there are case and counter case between the parties and both the sides are family members and there are general and omnibus allegations against all the accused persons, I am inclined to grant anticipatory bail to petitioner.
6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Pachamba P.S. case no.75 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
