RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:
1. Heard learned counsels for petitioners and for State.
2. The petitioners are apprehending their arrest in connection with Maheshpur P.S.Case No.110 of 2025, for offence registered under section 115(2), 85, 351(3) r/w 3(5) of BNS, 2023, section 3/ 4 of Dowry Prohibition Act and Section 4 of The Muslim Women (Protection of Right on Marriage) Act, 2019, pending in court of learned Chief Judicial Magistrate, Pakur.
3. Learned counsel for the petitioners submits that petitioner no.1 is mother-in-law and petitioner no.2 is husband of the informant. He submits that false allegations were made of torture and demand of dowry. He further submits that notice under section 35(3) of BNSS, 2023 has been received by the petitioners.
4. Learned State counsel opposes prayer and submits that allegations are there that they are trying to tamper with the evidence.
5. In view of the above and considering that the petitioners are mother-in-law and husband of the informant respectively and have received notice under section 35(3) of BNSS, 2023, in that view of the matter, petitioners above named are directed to surrender before learned court within two weeks from today and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as learned court may deed fit and proper.
6. This petition is disposed of.
