RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:
1. Heard learned counsel appearing on behalf of Petitioner and learned APP appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.46 of 2025, for the alleged offences registered under Sections 108 & 3(5) of BNS, pending in the Court of learned Judicial Magistrate, 1st Class, Jamshedpur.
3. Learned counsel appearing for the petitioner submits that the petitioner has extended friendly loan to the deceased and for return of the said loan, a cheque was issued by the deceased, which has been dishonoured and for that the petitioner has filed a complaint case being complaint Case No.182 of 2025 and then suicide has been made by the deceased. He submits that even in the suicide note, the signature of the deceased is not there and for the loan in question, an agreement has been entered into between the parties, which has been brought on record as Annexure -3. He submits that alleged occurrence is dated 22.06.2025, the deceased died on 26.06.2025 and the case has been lodged on 03.07.2025. He submits that apart from that there is no allegation against the petitioner.
4. Learned counsel for the State opposed the prayer and submits that the suicide note is there.

Considering that the loan has been extended by the petitioner, the agreement is on record, the cheque issued by the deceased has been dishonoured, for that the petitioner has lodged the complaint case and thereafter the suicide has been made, even in the suicide note, the signature of the deceased is not there and the alleged occurrence is dated 22.06.2025, the deceased died on 26.06.2025 and the case has been lodged on 03.07.2025, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur, in connection with Govindpur P.S. Case No.46 of 2025subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and disposed of.
