RANCHI, India, Oct. 7 -- Jharkhand High Court issued the following order on Sept. 8:
Heard Mr. Jitendra S. Singh, the learned counsel for the appellant and Mr. Pankaj Kumar, the learned P.P.
This appeal is directed against the order dated 04.08.2025 passed in Miscellaneous Criminal Application No. 1096 of 2025, arising out of Chakradharpur PS Case No. 131 of 2022 by the learned Additional Sessions Judge-I, Sub-Divisional Court, Chakradharpur (Chaibasa), whereby and whereunder, the prayer for bail of the appellant has been rejected. 
It has been alleged that the brother of the informant namely Kamaldeo Giri was murdered by the accused persons by firing at him and exploding a bomb. 
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confessional statements of the co-accused Matin Rahman and Gulzar Hussain. It has been submitted that the confessional statement of the appellant was recorded thrice by the prosecution agency and save and except the said confession of the appellant there is no other material which would indicate about the involvement of the appellant in committing the murder of the brother of the informant. The learned counsel further submits that the appellant is in custody since 23.11.2022 and that several co-accused persons have been granted bail by this Court.
Learned P.P. has opposed the prayer for bail of the appellant. 
Several co-accused persons seem to have been granted bail by this Court in Cr. Appeal (DB) No. 72 of 2024, Cr. Appeal (DB) No. 731 of 2025 and Cr. Appeal (DB) No. 723 of 2025. There does not seem to be any incriminating materials which have come to the fore consequent to the confessional statements of the appellant. 
Regard being had to the aforesaid facts, we while setting aside the order dated 04.08.2025 passed in Miscellaneous Criminal Application No. 1096 of 2025, arising out of Chakradharpur PS Case No. 131 of 2022 by the learned Additional Sessions Judge-I, Sub-Divisional Court, Chakradharpur (Chaibasa), direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Chakradharpur (Chaibasa) in connection with ST Case No. 217 of 2023 vide Miscellaneous Criminal Application No. 1096 of 2025. 
This appeal is allowed.
