RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:
1. Heard learned counsel appearing on behalf of Petitioner and learned APP appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Gomia P.S. Case No.98 of 2022, for the alleged offences registered under Sections 379, 411, 34 of IPC, pending in the Court of learned Judicial Magistrate, 1st Class, Bermo at Tenughat.
3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come only on suspicion and the petitioner has got no criminal antecedent and he has received the notice under Section 41A of Cr.P.C. and that has also been replied.
4. Learned counsel for the State opposed the prayer and submits that the allegations are there of theft of iron scraps.
5. In view of the above and considering that the petitioner has got no criminal antecedent and the petitioner has also replied the notice issued under Section 41A of Cr.P.C., the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition or sureties, the learned Court may deem fit and proper.
