RANCHI, India, Oct. 27 -- Jharkhand High Court issued the following order on Sept. 26:

1. Heard learned counsels for petitioner and for State.

2. The petitioner is apprehending his arrest in connection with Palajori PS Case No.32 of 2025, for offence registered under section 191(2), 191(3), 190, 126(2), 127(2), 121(1), 121(2), 118(1), 109(1), 223, 132, 324(3), 61(2) Of BNS, 2023, pending in court of learned Judicial Magistrate First Class, Madhupur.

3. Learned counsel for petitioner submits that death of one Meraj Ansari has been occurred at the instance of police and 500 persons have been assembled on the spot and were agitating and in view of that FIR was registered and there are general and omnibus allegations against all of the accused persons including the petitioner. He then submits that the petitioner has got one criminal antecedent as disclosed in para 12.

4. Learned State counsel opposes prayer and submits that petitioner is having one criminal antecedent.

Considering that allegations are made against 500 persons of assembling and pelting stones on the police and agitation was going on for death of aforesaid person at the instance of the police and there is one criminal antecedent against the petitioner, however, that cannot be a ground of rejecting the anticipatory bail or regular bail however that can be one of the grounds for allowing or rejecting the anticipatory bail or regular bail, and so far as this case is concerned, there are general and omnibus allegations against 500 persons, I am inclined to grant anticipatory bail to petitioner.

6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Madhupur, in connection with Palajori PS Case No.32 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
