RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:

1. Heard learned counsels for petitioner and for State.

2. The petitioner is apprehending his arrest in connection with Chandrapura PS Case No.06 of 2026, for offence registered under section 69 of the BNS, 2023, pending in court of learned A.C.J.M.-Cum-C.J.S.D.-1, Bermo at Tenughat, Bokaro.

3. Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case and the petitioner and the informant were in relationship two years prior to lodging of the FIR. He next submits that the allegations are made that the petitioner and the informant were planning for fleeing away from the house. He also submits that nothing has come in the medical report of establishing relationship. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned State counsel opposes prayer and submits that allegations are there of establishing relationship on the pretext of marriage.

5. Considering that the petitioner and the informant are major and in the FIR itself it has been stated that they were in relationship two years prior to lodging of the FIR, and, prima-facie, it suggests that what has happened, was consensual in nature, I am inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned A.C.J.M.-Cum-C.J.S.D.-1, Bermo at Tenughat, Bokaro, in connection with Chandrapura PS Case No.06 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
