RANCHI, India, Jan. 8 -- Jharkhand High Court issued the following order on Dec. 8:
1. Heard learned counsel representing the petitioner and learned counsel representing the respondents.
2. In this writ petition, the petitioner has prayed for grant of 1 st and 2nd ACP, which the petitioner has been deprived of, though the similarly situated employees have been granted the said benefits.
3. Learned counsel representing the respondents submits that if the petitioner files a fresh representation, the same will be considered and if the petitioner is found entitled to, the same will be extended to him.
4. Considering the aforesaid submission, I direct the petitioner to file a fresh representation before respondent No.2 - The Director, Department of Agriculture, Jharkhand, Government of Jharkhand, along with all the documents, within four weeks.
5. On receipt of such representation, the respondent - No.2, will consider the case of the petitioner and pass an appropriate order, within six weeks. If necessary and situation warrants, his case can be placed before the Committee who decides the issue of grant of ACP and MACP.
6. If the petitioner is found entitled for the any relief / consequential relief, the same shall be extended to him within two weeks thereafter.
7. If any part of the claim / representation of the petitioner is rejected, the reasons thereof must be communicated to the petitioner within the aforesaid period.
8. With the aforesaid directions, this writ petition stands disposed of.
