RANCHI, India, Jan. 24 -- Jharkhand High Court issued the following order on Dec. 23:

Heard Mr. Prem Mardi, learned counsel for the appellant and learned Spl. P.P. for the State.

This appeal is directed against the order dated 09.10.2025 passed in A.B.P. No. 2983 of 2025, arising out of Bero P.S. Case No. 48 of 2025, by the learned Judicial Commissioner, Ranchi, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.

It has been alleged that a mob of five hundred persons had surrounded the Sarna-Sthal and when the Police personnel tried to pacify them a scuffle had taken place and some properties as well as articles were vandalized.

It has been submitted by the learned counsel for the appellant that the allegations are general and omnibus in nature. It has further been submitted that some of the co-accused persons have been granted anticipatory bail by this court.

Learned Spl. P.P. for the State has opposed the prayer for anticipatory bail of the appellant.

Regard being had to the fact that no specific allegation has been levelled against the appellant, we while setting aside the order dated 09.10.2025 passed in A.B.P. No. 2983 of 2025, arising out of Bero P.S. Case No. 48 of 2025, by the learned Judicial Commissioner, Ranchi, the appellant is directed to surrender before the learned trial court within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Ranchi in connection with Bero P.S. Case No. 48 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.

This appeal is allowed.
