RANCHI, India, April 24 -- Jharkhand High Court issued the following order on March 24:
1. It is the grievance of the petitioner that he has worked from 1995 to 2010 as a Sectional Officer under the Panchayati Raj Department, Government of Jharkhand. It is his grievance that he has not been paid his salary for the aforesaid period.
2. Learned counsel for the respondents submits that it has to be first determined as to whether the petitioner has actually been engaged and worked, then only it can be considered as to whether the petitioner is entitled for the salary or not.
3. Counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation before the respondent No.-3 Deputy Commissioner, Ranchi, his case will be considered and an appropriate order will be passed and if it is found that the petitioner is entitled for the relief, the same will be granted to the petitioner.
4. Considering the aforesaid submission, I direct the petitioner to file a fresh representation annexing all the documents, before the respondent No.3- Deputy Commissioner, Ranchi within four weeks.
5. On receipt of such representation, the respondent No.3 will consider the representation of the petitioner and pass a reasoned order within six weeks.
6. If the petitioner is found entitled for any benefit, the same should be extended to him within two weeks thereafter.
7. If any part of the claim/ representation is rejected for any reason, a detailed speaking order should be communicated to the petitioner within aforesaid period.
8. With the aforesaid directions, this writ petition stands disposed of.
