RANCHI, India, March 10 -- Jharkhand High Court issued the following order on Feb. 9:
1. Heard Mr. Sourabh Kumar Das, learned counsel for the appellant and learned P.P.
2. This appeal is directed against the order dated 25.09.2025 passed by the learned A.J.C.-VI, Ranchi in B.P. No.1280/2025 arising out of GRP/Muri P.S. Case No.05/2025, whereby and whereunder the prayer for bail of the appellant has been rejected.
3. It has been alleged that under operation AAHT, a raid was conducted at Muri Station in Platform No.01 and 6 minor children along with 2 male persons were apprehended.
4. Submission has been advanced by the learned counsel for the appellant that the story projected by the prosecution with respect to the appellant having indulged himself in human trafficking is falsified by the statement of all the 6 minor children in which they have stated that they, with the permission of their parents, were going with the appellant to Andhra Pradesh for work. It has further been submitted that the appellant is in custody since 14.07.2025.
5. Learned P.P. has opposed the prayer for bail of the appellant and has submitted that an amount of Rs.50,000/- was deposited in the account of one Sangita Devi, who happens to be the sister of the appellant and the phone number of the appellant is also linked with the bank account number of his sister, which enhances the claim of the prosecution of the appellant having indulged himself in human trafficking.
6. On consideration of the statement of the children, who were purportedly being trafficked and which does reveal that they were going with the appellant with the permission of their parents to Andhra Pradesh for doing labour work and the period of custody undergone by the appellant, we while setting aside the order dated 25.09.2025, passed by the learned A.J.C.-VI, Ranchi in B.P. No.1280/2025, arising out of GRP/Muri P.S. Case No.05/2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned A.J.C.-VI, Ranchi in B.P. No.1280/2025 arising out of GRP/Muri P.S. Case No.05/2025.
7. Accordingly, this appeal is allowed.
