RANCHI, India, Jan. 8 -- Jharkhand High Court issued the following order on Dec. 8:
1. Learned counsel for the petitioner submits that the petitioner has been convicted to undergo SI for six months along with fine of Rs.3,50,000/- under section 138 of Negotiable Instrument Act, 1881 and in default of fine to undergo SI for three months passed in Complaint Case No.2027 of 2020 by learned Judicial Magistrate First Class, Dhanbad. He further submits that the judgment is under challenge in Cr.Appeal No.41 of 2025 and the learned court has been pleased to dismiss the appeal by the judgment dated 30.07.2025. He next submits that the petitioner has surrendered on 29.10.2025.
2. I.A. No.15076 of 2025 has been filed for suspension of sentence and for grant of regular bail.
3. He further submits that he has got instruction that the petitioner is ready to pay 10% of the cheque amount to the complainant.
4. Learned counsel for the State appearing through V.C submits that matter is arising out of section 138 of Negotiable Instrument Act, 1881.
5. Learned counsel for the complainant submits that at least 50 % of the amount may kindly be directed to be paid to the complainant by the petitioner.
6. In view of above and considering that the petitioner is in custody and he is ready to pay 10% of the cheque amount to the complainant and in that view of the matter, the petitioner is directed to pay Rs.25,000/- to the complainant through his learned counsel by way of demand draft by 22.12.2025.
7. In view of above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Dhanbad, in connection with Complaint Case No.2027 of 2020.
8. It is open to the O.P.No.2 that if the aforesaid direction is not complied by the petitioner, he may file proper petition before this Court.
9. The instant I.A stands disposed of.
