RANCHI, India, June 6 -- Jharkhand High Court issued the following order on May 6:

Heard the learned counsel for the respective sides.

The objection filed by Mr. Arup Kr. Dey, learned A.P.P. is accepted.

This appeal is directed against the order dated 23.09.2024 passed in B.P. No. 568 of 2024 in connection with Kunda Case No. 46/2021 by learned Sessions Judge, Chatra, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that on the basis of a secret information, a raid was conducted by the police at which several persons who had assembled had started firing and ultimately they fled away. So far as the appellant is concerned, he seems to have been implicated only on account of the confidential information. Some of the co-accused persons have been granted bail by this Court in B.A. 222 of 2024 and B.A. No. 4019 of 2024. The appellant is in custody since 31.07.2024.

Regard being had to the above, we while setting aside the order dated 23.09.2024 passed in B.P. No. 568 of 2024 in connection with Kunda Case No. 46/2021 by learned Sessions Judge, Chatra, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Kunda Case No. 46/2021 (G.R. No. 1469 of 2022).

This appeal is allowed.
