RANCHI, India, Nov. 19 -- Jharkhand High Court issued the following order on Oct. 29:
1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Kanke P.S. Case No. 323/2023, registered for the offence under sections 406/420/467/468/479/120B/34 of IPC, pending in the Court of learned Chief Judicial Magistrate, Ranchi.
3. Learned counsel appearing for the petitioner submits that there is general and omnibus allegation against the petitioner and the learned court has been pleased to reject the anticipatory bail applications considering that the successive anticipatory bail application has been filed.
4. Learned counsel for the State opposed the prayer for anticipatory bail submitting that the petitioner is having three criminal antecedents. Even the fresh ground is not shown for filing of successive anticipatory bail application, the learned Court has rightly passed the said order as on the same ground, second anticipatory bail has been filed.
5. In view of the above and considering the changed circumstance is not shown in filing the second anticipatory bail, this anticipatory bail application is dismissed.
6. However, if the petitioner surrenders before the learned Court by way of filing proper application, the learned Court will decide the same in accordance with law without being prejudiced to this order.
