RANCHI, India, April 24 -- Jharkhand High Court issued the following order on March 24:
1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.
2. It is the grievance of the petitioner that the land has been acquired by the National Highway Authority for construction of National Highway under the National Highways Act. An Award has already been prepared but not in the name of this petitioner but in the name of other co-sharer.
3. It is the claim of the petitioner that he is also a co-sharer of the property in question and Award should also been prepared in his name.
4. During course of argument, learned counsel for the petitioner submits that he has filed an appropriate application under the National Highways Act before the competent authority who only had to refer the matter for adjudication but the same has not been done by him. He prays that a direction be given to the Authority to refer the matter before the appropriate Forum for adjudication.
5. Learned counsel for the State submits that if the matter has yet not been referred, an appropriate order would be passed on the application of the petitioner at the earliest.
6. Considering the said submission, I direct the respondent no. 5-District Land Acquisition Officer, Bokaro to pass an appropriate order on the application of the petitioner in terms of the provisions of the National Highways Act.
7. If an order is passed for reference, a copy of the order should also be communicated to the petitioner. The decision should be taken within a period of four weeks from the date of receipt of the copy of this order.
8. Accordingly, this writ petition is disposed of.
