RANCHI, India, Dec. 26 -- Jharkhand High Court issued the following order on Nov. 26:
1. After some argument, it was disclosed by the learned counsel for the parties that the impugned order dated 19.06.2024, passed in W.P.(S) No. 1846 of 2023, is subject to two pending review applications, Civil Review No. 124 of 2025, filed by C.C.L., and Civil Review No. 15 of 2025, filed by Anita Devi, who is said to be the first wife of the deceased employee.
2. Mr. Prashant Vidyarthi, learned counsel appearing for the appellant - CMPF, has submitted that at this stage, he may be granted liberty to withdraw this appeal in order to file an appropriate application in the pending review petition, so as to raise all the relevant issues.
3. There is no opposition by the learned counsel appearing for the respondents including the writ petitioner.
4. Considering the leave so sought for the present appeal is dismissed as withdrawn. However, liberty is reserved to the appellant - CMPF to approach appropriate forum in case of any cause of action subject to the present issue.
5. Accordingly, the instant Letters Patent Appeal, being L.P.A. No. 470 of 2024, is hereby, dismissed as withdrawn and as such disposed of.
6. Pending interlocutory application(s), if any, also stands disposed of.
