RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:
1. Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Amra Para P.S. Case No.70 of 2025 for the alleged offences registered under Sections 303(2), 305(e), 317(2), 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 30(ii) of Coal Mines (Nationalization) Act pending in the Court of learned C.J.M., Pakur.
3. Learned counsel appearing for the petitioners submits that petitioners are owners of four different motorcycles and the allegations are made of loading three quintal of coal on each of the motorcycle. He further submits the petitioners were taking the said coal for their personal use. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition and co-accused persons have been granted anticipatory bail in ABA No.1482 of 2026.
4. Learned counsel appearing for the State opposed the prayer and submits that illegally coal was being carried in the said motorcycles.
5. Considering that the petitioners were taking the said coal for their personal use and the petitioners have got no criminal antecedent as aforesaid and the co-accused persons have been granted anticipatory bail as aforesaid, both the petitioners, above named, are hereby directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to the satisfaction of learned C.J.M., Pakur, in connection with Amra Para P.S. Case No.70 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
