RANCHI, India, June 12 -- Jharkhand High Court issued the following order on May 11:
1. Heard the parties.
2. It is the grievance of the petitioner that the petitioner has filed an application before the Collector/Circle Officer, under the Bihar (Jharkhand) Public Land Encroachment Act to initiate an encroachment proceeding against the alleged encroachers, but Collector/Circle Officer is sitting tied over the matter and has not taken any steps.
3. Learned counsel for the petitioner submits that if a direction is given to the Circle Officer, Simdega to initiate a proceeding and proceed as per law against the encroachers.
4. Learned counsel appearing on behalf of the respondents submits if the application is still pending, appropriate direction can be given to the Circle Officer, Simdega to proceed.
5. Considering the said facts, I direct the respondent No.5-Circle Officer, Simdega, to proceed, as per law, on the representation filed by the petitioner under Section 3 of the Bihar (Jharkhand) Public Land Encroachment Act and disposed of the same, after hearing all the parties, as per law, as early as possible.
6. With the aforesaid observations, this writ petition stands disposed of.
