RANCHI, India, Dec. 26 -- Jharkhand High Court issued the following order on Nov. 26:
1. The present writ petition has been filed for the following reliefs :-
"(a) for issuance of appropriate writ(s) / order(s) /direction(s) in the nature of certiorari for quashing the letter as contained in Memo No. 336 dated 13.05.2025 (Annexure-3) along with letter appended thereto issued from the office of the Deputy Commissioner-cum-District Magistrate, Ranchi directing the Senior Superintendent of Police, Ranchi to take action against the Petitioner in pursuance of Section 14
(i) and
(ii) of the Securitization and Reconstruction of Financial Assets and Security Interest Act, 2002 (SARFAESI Act) as the said letter has been issued without considering the fact that the application of the Petitioner under section 17 of SARFAESI Act is still pending before Debt Recovery Tribunal at Ranchi.
(b) for issuance of appropriate writ(s) / order(s) / direction(s) restraining the Deputy Commissionercum-District Magistrate, Ranchi from passing any order in exercise of power conferred upon him under section14 (i) and (ii) of the SARFAESI Act during pendency of S.A. No. 13 of 2021 filed by the Petitioner before the Debt Recovery Tribunal, at Ranchi under section 17 of the SARFAESI Act.."
2. Since the appeal is already pending before the appellate authority, I am not inclined to entertain the present writ petition.
3. However, the petitioner is at liberty to pursue his remedy before the appellate authority where the appeal is pending.
4. Accordingly, the present writ petition stands disposed of with the aforesaid liberty.
5. Pending interlocutory application, if any, stands disposed of.
