RANCHI, India, Nov. 19 -- Jharkhand High Court issued the following order on Oct. 29:

1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State and informant.

2. The petitioner is apprehending her arrest in connection with the Itkhori P.S. Case No. 65/2024, registered for the offence punishable under Section 420, 166(a), 217, 420, 466, 409, 467, 120(B) of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioner submits that the petitioner was appointed as Para Teacher in the year 2002 and till the filing of the complaint by a private person, the petitioner was working as Para Teacher. He then submits that allegations are made that on the basis of forged document, the petitioner has obtained the appointment on the post of Para Teacher. He further submits that the petitioner is having the valid certificates and that have been disputed and in view of that, FIR has been registered. He also submits that the petitioner is a lady and she is cooperating in the investigation.

4. Learned counsel appearing for the State and informant have jointly opposed the prayer and submits that on the forged documents, the said appointment has been obtained by the petitioner.

In view of the above and considering that the petitioner was working since 2002 and the complaint has been registered in the year 2024, which has been converted into FIR, there are documents on behalf of the petitioner, which suggest that the petitioner was having the qualification, whereas the learned counsel for the State and Informant have disputed the same and the petitioner is cooperating in the investigation, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of her surrender / arrest, she shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Itkhori P.S. Case No. 65/2024, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.

7. This Anticipatory Bail Application is accordingly allowed and disposed of.
