Heard the learned counsel for the respective parties.
This application has been preferred by the appellant for condoning a delay of 51 days in filing the appeal.
Having been satisfied with the reasons assigned in this application, the delay of 51 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.
Cr. Appeal (DB) No. 1319 of 2025
This appeal is directed against the order dated 18.07.2025 passed by the learned Additional Sessions Judge-III, Latehar in Bail Petition No. 314 of 2025, arising out of Balumath PS Case No. 183 of 2023, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on a raid conducted near village Hesabar one co-accused namely Sahadev Ganjhu was apprehended and several arms and ammunitions were recovered from his possession. Submission has been advanced by the learned counsel for the appellant that he has been implicated on the confessional statement of co-accused Sahadev Ganjhu.
It has further been submitted that nothing incriminating has been recovered from the possession of the appellant.
Learned counsel adds that Sahadev Ganjhu has been granted bail by a co-ordinate Bench of this Court in Cr. Appeal (DB) No. 1042 of 2024. It is also stated that the appellant is in custody since 04.03.2025.
Learned Spl.P.P. though has opposed the prayer for bail of the appellant but does not dispute the aforesaid fact.
Regard being had to the manner of implication of the appellant, we while setting aside the order dated 18.07.2025 passed by the learned Additional Sessions Judge-III, Latehar in Bail Petition No. 314 of 2025, arising out of Balumath PS Case No. 183 of 2023, direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath PS Case No. 183 of 2023.
This appeal is allowed.
