1. Heard Mr. Rakesh Kumar, learned counsel for the appellant and learned A.P.P. for the State.
2. This application has been preferred by the appellant for condoning the delay of 15 days in filing of this appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 15 days in filing this appeal is hereby, condoned.
3. I.A. No.16295 of 2025 stands disposed of.
Cr. Appeal (D.B.) No.1520 of 2025
4. This appeal is directed against the order dated 20.09.2025 passed by the learned Additional Sessions Judge-III, Latehar in M.C.A No.698 of 2025 in connection with S.T. No.165 of 2025 arising out of Latehar P.S. Case No.284 of 2022, whereby and whereunder, the prayer for bail of the appellant has been rejected.
5. It has been alleged that there was an exchange of firing between the police personnel and the extremists and being outmaneuvered the extremists had managed to flee away.
6. Submission has been advanced by learned counsel for the appellant that the appellant has been implicated only on account of the allegation that while fleeing away the extremists were taking the name of each other. Learned counsel further submits that the appellant is in custody since 11.02.2025 and similarly situated, some of the co-accused persons have been granted bail by the Co-ordinate Bench of this Court in Cr. Appeal (D.B.) No.93 of 2024 and Cr. Appeal (D.B.) No.978 of 2024.
7. Learned Spl.P.P. has opposed the prayer for bail of the appellant.
8. Regard being had to the manner of implication of the appellant and the fact that similarly situated co-accused have been granted bail as noted above, we, while setting aside the order dated 20.09.2025 passed in M.C.A No.698 of 2025 in connection with S.T. No.165 of 2025 arising out of Latehar P.S. Case No.284 of 2022, direct the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Latehar.
9. This appeal is allowed.
