RANCHI, India, Nov. 19 -- Jharkhand High Court issued the following order on Oct. 29:
1. Heard learned counsels for petitioners and for State.
2. The petitioners are apprehending their arrest in connection with Jaridih PS Case No.108 of 2024, for offence registered under section 190, 191(2), 191(3), 115(2), 117(2), 118(1), 118(2), 109, 351(2) of BNS, 2023, pending in court of learned A.C.J.M., Bermo at Tenughat.
3. Learned counsel for petitioners submits that there are case and counter case between the parties and dispute is there with regard to land. He then submits that so far as assault is concerned that allegation is not against the petitioners and the assault allegation is made against Dhirendra Mahto and Parikshit Mahto and they have been granted regular bail. He also submits that in identical situation the co-accused have been granted anticipatory bail in ABA No.3486 of 2025.
4. Learned State counsel opposes prayer and submits that allegation of assault is there.
5. Considering that assault allegation is made against Dhirendra Mahto and Parikshit Mahto and they have been granted regular bail and in identical situation the co-accused have been granted anticipatory bail in ABA No.3486 of 2025 and there is case and counter case between the parties with regard to the land dispute, I am inclined to grant anticipatory bail to petitioners.
6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), each with two sureties of like amount each, to satisfaction of learned A.C.J.M., Bermo at Tenughat, in connection with Jaridih PS Case No.108 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
