RANCHI, India, Oct. 27 -- Jharkhand High Court issued the following order on Sept. 26:
1. Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection with Petarwar PS Case No.98 of 2025, for offence registered under section 69 of BNS, 2023, pending in court of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat.
3. Learned counsel for petitioner submits that false allegation is made against the petitioner. He submits that allegation of establishing of the relationship is of 16.06.2023 and FIR is lodged on 1.7.2025. He then submits that the petitioner has refused to marry.
4. Learned State counsel opposes prayer and submits that on the pretext of marriage relationship has been established.
5. Considering that in the FIR itself it is disclosed that relationship was established on 16.6.2023 and thereafter also both of them met at different places and the FIR is lodged on 1.7.2025 and the informant is aged about 20 years, I am inclined to grant anticipatory bail to petitioner.
6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Petarwar PS Case No.98 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
