Mr. Sagar Kumar, learned counsel for the appellant is permitted to make correction in the cause title of this application with respect to the provision of law.

Heard Mr. Sagar Kumar, learned counsel for the appellant and Mr. Shailesh Kr. Sinha, learned A.P.P.

This application has been preferred by the appellant for condoning a delay of 38 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and a delay of 38 days in filling the appeal is hereby condoned.

I.A. No. 8514 of 2025 stands disposed of.

Cr. Appeal (DB) No. 876 of 2025.

This appeal is directed against the order dated 09.04.2025 passed by the learned Additional Sessions Judge-V, Dhanbad in B.P. No. 130/2025 in connection with Madhuban P.S. Case No. 11/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that appellant has provided weapons and money to Bajrangi Paswan and from the office of the appellant, a country made pistol, three live cartridges and two sutli bombs were recovered.

It has been submitted by the learned counsel for the appellant that though the appellant has got several criminal antecedents, but in two cases he has been acquitted and in rest of the cases, he is on bail. It has been submitted that the appellant is in custody since 31.01.2025 and at the time when the search was conducted, the appellant was in custody.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the manner of implication of the appellant and the period of custody undergone by him, we, while setting aside the order 09.04.2025 passed by the learned Additional Sessions Judge-V, Dhanbad in B.P. No. 130/2025 in connection with Madhuban P.S. Case No. 11/2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Dhanbad in connection with Madhuban P.S. Case No. 11/2025.

This appeal is allowed.
