RANCHI, India, March 10 -- Jharkhand High Court issued the following order on Feb. 9:

1. Heard the learned counsel representing the petitioners and the learned counsel representing the respondents.

2. The petitioners in this writ petition have prayed to appoint the petitioners in the post against which they have applied pursuant to the Advertisement issued by the JSSC for filling up of the post of Graduate Trained Teacher. The Combined Graduate Trained Teacher Competitive Exam, 2016 was held pursuant to the Advertisement No. 21 of 2016. Petitioner no. 1 applied for the post of Teacher in Sanskrit and petitioner no. 2 applied for the post of Teacher in Hindi. The petitioners claims that the petitioner no. 1 obtained 200 marks which is more than the cut-off marks i.e. 150 in Sanskrit and petitioner no. 2 obtained 204 marks which is more than the cut-off marks which was 150 in Hindi. Only on the basis that the petitioners had obtained more marks than the cut-off marks, the petitioners claims appointment.

3. Securing more marks than the cut-off marks, itself is not sufficient to be appointed. To claim appointment the petitioners must establish that the petitioners have obtained more marks, than the last selected candidate and/or any other candidate who has been appointed in the category of the petitioner.

4. In the entire petition there is no pleadings nor there is any evidence to the effect that any one obtaining lesser marks than the petitioners in their respective category has been appointed. Since there is no material to suggest that any one obtaining lesser marks than the petitioners have been appointed in Sanskrit or Hindi respectively, the petitioners cannot claim appointment as a matter of right.

5. Thus, I find no merit in this writ petition, accordingly, the instant writ petition is dismissed.
