RANCHI, India, Sept. 17 -- Jharkhand High Court issued the following order on Aug. 18:

1. In this writ petition, the petitioner has prayed for the following reliefs:

(i) for issuance of an appropriate writ(s), order(s), direction(s) commanding upon the concerned respondents to grant 1st ACP and 2 nd MACP and after granting the same, revised the pensionary benefits as well as consequential benefits to the petitioner.

(ii) for issuance of an appropriate writ(s), order(s), direction(s) commanding upon the concerned respondents to grant annual increment, which has not been given to the petitioner during entire service tenure and also provide consequential monetary benefits to the petitioner.

2. Learned counsel for the petitioner submits that as his representation is already pending before the respondents, suffice it would be, if a direction is given to the respondents to consider the claim of the petitioner.

3. Learned counsel appearing on behalf of the State submits that if the petitioner files a detailed representation before the respondent no. 2-the Secretary, Water Resources Department, his case will be considered.

4. Considering the submission of the parties, I direct the petitioner to file a fresh representation before the respondent no. 2-the Secretary, Water Resources Department who will consider the case of the petitioner.

5. The representation should be filed within four weeks and the decision should be taken within eight weeks thereafter.

6. If it is found that the petitioner is entitled for any monetary benefits the same should be extended to the petitioner. If the claim of the petitioner is rejected for any reasons whatsoever the reasons should be communicated to the petitioner within a period of four weeks thereafter.

7. With the aforesaid observation and direction, this writ petition is disposed of.
