RANCHI, India, Jan. 23 -- Jharkhand High Court issued the following order on Dec. 22:
Heard Mr. Soumitra Baroi, learned counsel for the appellant and learned A.P.P. for the State.
This appeal is directed against the order dated 07.10.2025 passed in B.P. No. 398 of 2025, arising out of Mahuadanr P.S. Case No. 29 of 2024, by the learned Additional Sessions Judge-I, Latehar, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on an information that two girls have been kept captive in Gram Panchayat Bhawan, the informant had gone to the said place and on being questioned all the victims had taken the name of the appellant and had also stated that the appellant was intending to take them to a Yarn factory at Chennai.
Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 30.07.2025. It has further been submitted that the appellant was not apprehended at the spot and merely on the disclosure of the victims he has been implicated.
Learned A.P.P. has opposed the prayer for bail of the appellant.
It appears that the statement of the victim u/s 164 Cr.P.C. were recorded, in which, they have stated that this appellant was instrumental in preparing to take them to Chennai to work in a Yarn factory.
However, considering the period of custody undergone by the appellant, we while setting aside the order dated 07.10.2025 passed in B.P. No. 398 of 2025, arising out of Mahuadanr P.S. Case No. 29 of 2024, by the learned Additional Sessions Judge-I, Latehar, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Latehar in connection with Mahuadanr P.S. Case No. 29 of 2024.
This appeal stands allowed.
