RANCHI, India, June 4 -- Jharkhand High Court issued the following order on May 5:
1. Heard Mr. Agnivesh, learned counsel for the appellant and Mr. Shiv Shankar Kumar, learned A.P.P.
2. This appeal is directed against the order dated 03.12.2024 passed in Misc. Cr. Application No. 1584 of 2024 in connection with S.T. Case No. 323 of 2023 by the learned Additional Sessions Judge-II, Chatra, whereby and whereunder, the prayer for bail of the appellant has been rejected.
3. It has been alleged that one Pradeep Kumar Ganjhu @ Prabhat Ji was apprehended by the police and a mobile phone and Rs-55,500/- in cash was recovered from his possession.
4. So far as the present appellant is concerned, he seems to have been implicated on confessional statement of the apprehended co-accused persons. Several co-accused persons have been granted bail by this Court in Criminal Appeal (DB) No. 1465 of 2022, Criminal Appeal (DB) No. 972 of 2022 and
Criminal Appeal (DB) No. 1241 of 2022. The appellant is in custody since, 31.03.2022.
5. Regard being had to the aforesaid facts, we, while setting aside the order dated 11.02.2025 passed by the learned Additional Sessions Judge-II, Chatra in Misc. Cr. Application No. 1584 of 2024 in connection with S.T. Case No. 323 of 2023, direct that the appellant, above named, be released on bail on furnishing bail
bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Chatra in connection with S.T. Case No. 323 of 2023 arising out of Simaria P.S. Case No. 30 of 2018.
6. This appeal is allowed.
