RANCHI, India, Jan. 7 -- Jharkhand High Court issued the following order on Dec. 8:
1. Heard the parties.
2. The present writ petition has been filed for the following relief :-
"for issuance of appropriate writ(s) / order(s) /direction(s), particularly a writ in the nature of mandamus commanding upon the respondents to provide specific information to the petitioner on his application under R.T.I. Act, 2005, wherein the petitioner sought information from the respondents under Section 6 of the R.T.I. Act about the Memorandum of Understanding (M.O.U.) made / agreed in between the Govt. of Jharkhand and Maithan Power Limited, Maithan, but the respondents have neither replied the same nor given information about the M.O.U. made between the Govt. of Jharkhand and Maithan Power Limited, Maithan."
3. From the pleadings, it appears that the required information has not been supplied to the petitioner. Thereafter, he has preferred first appeal being First Appeal Application No. 03/ 2025 and after hearing the parties, the said first appeal has been disposed of on 13.02.2025, assigning the reason that the information sought for is beyond the kept record.
4. It is settled principle of law that information is only to be supplied which is available on the record and not in the mind of one or other authority. This is not the methodology to show cause any authority. This is nothing but misuse of the right given to a common citizen.
5. In that view of the matter, this Court finds no reason to entertain the present writ petition. Accordingly, it is, hereby, dismissed.
6. Pending interlocutory application, if any, stands disposed of.
