Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 26.05.2025 passed in A.B.P. No. 193 of 2025 in connection with Madhupur P.S. Case No. 28/2025 by the learned Vacation Judge, Madhupur (Deoghar), whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
It has been alleged that a bomb was thrown at the husband of the informant which resulted in his death.
Submission has been advanced by the learned counsel for the appellant that the appellant has been named in the Frist Information Report on the basis of suspicion since the appellant was a Para Teacher who was removed from service who had a grudge against the deceased which resulted in his throwing a bomb at the deceased. Learned counsel submits that the name of the appellant has also come in the confessional statement of one Mukesh Kumar Choudhary whose name was taken by Baldeo Ray and the role of the appellant has been attributed in such confessional statement to be of showing the other accused persons, the road through which the deceased husband of the informant frequented while coming from school.
Learned A.P.P. has opposed the prayer for bail of the appellant and has referred to the confessional statements of some of the accused persons as recorded in the case diary. He has further stated that there is no other incriminating material against the appellant, save and except the confessional statement of Mukesh Kumar Choudhary.
On consideration of the fact that the appellant has been implicated only on account of a suspicion due to a previous incident of the appellant being removed from the school where he was working as a Para Teacher, we while setting aside the order dated 26.05.2025 passed in A.B.P. No. 193 of 2025 in connection with Madhupur P.S. Case No. 28/2025 by the learned Vacation Judge, Madhupur (Deoghar), direct the appellant to surrender before the learned trial court within a period of four weeks and on such surrender, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhupur, Deoghar in connection with Madhupur P.S. Case No. 28/2025, subject to the conditions laid down u/s 482 BNSS.
This appeal is allowed.
