RANCHI, India, June 6 -- Jharkhand High Court issued the following order on May 6:
Heard Mr. Vikash Kumar, learned counsel for the appellant and Mr. Pankaj Kumar, learned P.P.
This appeal is directed against the order dated 05.12.2024 passed by the learned Additional Sessions Judge-I, Dhanbad in A.B.P. No. 3139 of 2024 in connection with Putki (Bhagabandh O.P.) P.S. Case No. 109 of 2021, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It appears that the appellant had earlier moved for grant of bail before this Court in Cr. Appeal (DB) No. 625 of 2024 which, however, was rejected vide order dated 27.06.2024.
The fresh ground which has been taken by learned counsel for the appellant to renew his prayer for bail is the ailment of his mother who is suffering from some heart disease, for which a supplementary affidavit has been filed bringing on record some medical prescriptions.
Learned A.P.P. has opposed the prayer for bail of the appellant.
On consideration of the fact that the appellant has got criminal antecedent and is a member of the dreaded Aman Sahu Gang, his prayer for bail was rejected earlier. Their does not appear to be any fresh ground save and except, the illness of his mother which can very well be looked after by other family members. In the facts and circumstances of the case, we do not find the ground taken by the learned counsel for the appellant to be tenable and we, accordingly, dismiss this appeal once again.
