The objection filed by Mr. Rajneesh Vardhan, learned A.P.P. at the Bar is kept on record.
Heard Mr. Raja Ravi Shekhar Singh, the learned counsel for the appellant and Mr. Rajneesh Vardhan, the learned A.P.P.
This appeal is directed against the order dated 17.07.2025 passed in B.P. No. 497 of 2025 arising out of Dhanbad GRPS Case No. 28 of 2025 by the learned Additional Sessions Judge-IV, Dhanbad, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that 14 persons were apprehended while they were boarding a train and the appellant, who was said to be the head of the persons who were apprehended, had disclosed that they were being taken to Tamil Nadu for working in JSS Company where he also works as a labourer.
Submission has been advanced by the learned counsel for the appellant that 14 persons were being taken to Tamil Nadu for the purposes of working and in fact the appellant was also a clerk in the very same Company. The learned counsel submits that the appellant is in custody since 26.04.2025 and out of 14 persons 09 were found to be major whereas 05 persons were found to be minors.
Learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant is involved in human trafficking. He however admits that the appellant does not have any criminal antecedent.
On consideration of the fact that all the children were recovered and the role played by the appellant of getting the said persons as a labourer in the Company in which he was working, we while setting aside the order dated 17.07.2025 passed in B.P. No. 497 of 2025 arising out of Dhanbad GRPS Case No. 28 of 2025 by the learned Additional Sessions Judge-IV, Dhanbad direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, 1st Class, Dhanbad in connection with Dhanbad GRPS Case No. 28 of 2025.
This appeal is allowed.
