RANCHI, India, Jan. 7 -- Jharkhand High Court issued the following order on Dec. 8:

1. The petitioner has been dismissed from service. It is the grievance of the petitioner that the person who has passed the order of dismissal is not the appropriate authority.

2. Admittedly the petitioner was an acting head master in aided minority educational institution.

3. The Jharkhand Education Tribunal Act, 2005 has been promulgated to redress the grievance of teachers of aided educational institutions and private educational institutions, addressing issues like recruitment, service conditions, and management disputes, and that of grievances of the parents and students studying therein providing an efficient alternative to regular courts. The definition educational institution as per 2(n) of same act means any educational institution managed and administered by private management. Further the service matter is defined in Section 2(m) which means matter relating to condition of his service in connection with the affairs of the educational institution other than government institution.

4. Admittedly, this institution is not a government institution. Thus, the petitioner should approach the Jharkhand Educational Tribunal for redressal of his grievance.

5. Accordingly, this writ petition stands disposed of.
